By accessing or using any services provided by IgniteAI KC LLC ("IgniteAI KC," "we," "us," or "our"), including submitting a form on our website, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

1. Services

IgniteAI KC LLC provides the following services to small businesses and organizations:

• Custom Website Design and Development - mobile-first websites built to rank on Google and convert visitors into leads, including managed hosting and ongoing maintenance.
• Business Automation - systems that automate follow-up, customer communication, lead response, review requests, appointment reminders, and other repetitive business processes.
• Sports and League Systems - registration, scheduling, team management, and facility websites for youth sports organizations and training facilities.
• IgniteAgent - an AI-powered lead qualification and CRM automation platform for insurance agents and sales professionals, including AI voice outreach, lead scoring, and automated follow-up sequences.

By submitting any form or engaging with our services, you consent to be contacted by IgniteAI KC LLC regarding your inquiry.

2. SMS and Telephone Communications

By submitting your phone number through any form on our website, you consent to receive:

• Automated or pre-recorded voice calls regarding your inquiry
• SMS text messages related to your request, follow-up, and appointment reminders
• Re-engagement communications related to services you have expressed interest in

Message and data rates may apply. Message frequency varies based on your interaction with us. Consent to receive SMS or automated calls is not a condition of any purchase.

To opt out of SMS messages at any time, reply STOP to any message you receive. To get help, reply HELP. After opting out, you will receive one final confirmation message. You may opt back in at any time by texting START.

No sharing of SMS opt-in data: We do not sell, rent, lease, or share your phone number or SMS opt-in consent with any third party for marketing purposes.

3. AI-Powered Tools

Our services include AI-powered voice agents, chat assistants, and automated communication tools. These tools will identify themselves as AI at the start of any interaction. They are not human representatives. Interactions with AI tools may be logged and transcribed for quality review. Call recordings are subject to applicable state and federal notification requirements - callers are notified at the start of each recorded call.

4. Website Services

For clients who purchase website design and development services, the following apply:

• Website builds include the agreed scope of work as discussed during onboarding. Changes beyond agreed scope may be subject to additional fees.
• Managed hosting and maintenance plans are month-to-month. Either party may cancel with 30 days notice. Upon cancellation, all website files and content will be made available for export.
• The client is responsible for providing accurate business information, approved content, and timely feedback during the build process. Delays caused by client inaction may extend launch timelines.
• Clients retain ownership of their domain name at all times.

5. User Responsibilities

You agree to provide accurate and truthful information when submitting forms or interacting with our services. You are responsible for ensuring that any content you provide for use in websites or automation systems does not infringe on third-party intellectual property rights.

6. Third-Party Services

IgniteAI KC LLC uses third-party services including but not limited to GoHighLevel (CRM), Bland.ai (voice communications), Make (automation), and OpenAI (chat). Your information may be shared with these services as necessary to deliver the services you requested. We do not sell your personal information to third parties for marketing purposes.

7. Age Restriction

Our services are intended for use by individuals who are 18 years of age or older. By using our services or submitting any form on our website, you represent and warrant that you are at least 18 years old. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that a person under 18 has submitted information, we will delete it promptly.

8. Carrier Liability Disclaimer

IgniteAI KC LLC is not responsible for any delays, failures, or errors in the delivery of SMS messages caused by wireless carriers, network conditions, or other factors outside our control. Message delivery is subject to the terms and conditions of your mobile carrier. Carriers are not liable for delayed or undelivered messages.

9. Limitation of Liability

To the maximum extent permitted by law, IgniteAI KC LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to website downtime, missed leads, or automation errors. Our total liability for any claim arising from our services shall not exceed the total fees paid by the client in the 30 days prior to the claim.

10. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Continued use of our services after any changes constitutes your acceptance of the revised terms. Active clients will be notified of material changes.

12. Governing Law

These Terms shall be governed by the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Jackson County, Missouri.
